The Department of Advisory and Legal Services was created by the Attorney General and Honourable Commissioner for Justice, Ekiti State, Mr. Olawale Fapohunda on the 9th day of April, 2019.

CORE MANDATE

The following are the core mandate of the Directorate:

i). Participating in Personnel Management Board Meetings on matters that bother on disciplinary matters of both junior and senior staff within the Ekiti Sate Civil Service;

ii). Attending to matters relating to the welfare of both serving and retired Judges in the Ekiti State Judiciary;
iii. Rendering of legal advice on civil petitions received from the MDAs of the Ekiti State, private persons and corporate organizations;

iv). Acting as Legal Adviser on legal matters in all the 16 Local Government Areas of Ekiti State. Managing the case profile of the various Local governments in the State to avoid litigation embarrassment.

2.0 ACTIVITIES OF THE DEPARTMENT SINCE ITS ESTABLISHMENT

2.01 HIGH COURT COMPLEX

The first assignment carried out by this Department was on the 10th day of April, 2019. The Department, on the instruction of the learned Attorney General wrote a letter to the Chief Judge of Ekiti State through His Excellency, Dr. John Kayode FAYEMI mandating the Judiciary to move to the new High Court Complex named after my Lord, Honourable Justice Ademola Ajakaye, the Oluyin of Iyin – Ekiti. The Complex has since been put to use.

2.02 WRITING OF LEGAL ADVICE

2.03 The Department during the period spanning 9th April – August 12th, 2019 has proffered legal advice to the various civil petitions and letters assigned to it. In all, we have treated well over 25 of this.

2.04 The outstanding ones shall be resolved when the required responses from the relevant MDAs are received.

3.00 LOCAL GOVERNMENT

3.01 The Department serves as Liaison Office for the Sixteen Local Governments. Presently, the department is the legal adviser to all the sixteen local government areas of the State. It has successfully streamlined the litigation profile of the various Local Governments since its inception. The department is handling cases for Ado – Ekiti; Ikere – Ekiti; Ilejemeje, Ise/Orun, Emure and Ifelodun/Irepodun Local governments respectively.

It is instructive to note that, the department has negotiated many cases out of Court since its inception.

4.00 APPOINTMENT OF LEGAL ADVISERS TO MDAs

4.01 Primarily, one of the major reasons for establishing this department is to ensure that the Department serves as store house for the posting of legal advisers to the various MDAs in the State. This is to put an end to instances whereby MDAs choose for the Ministry a particular law officer desired as legal adviser on issues relating to discipline of civil servant and other service matters.

Flowing from the above, 3 law officers were nominated directly from the Ministry on the recommendation of the Department to serve on Committees on: Public Service Rules Review; Review of Financial Administration of Ekiti State and Civil Service Regulation Review. This is a marked departure from what it used to be in the past.

DRAFT DIRECTIVE ON COORDINATING LEGAL ADVISERS TO MDAs

1. Legal Advisers are to ensure a cordial relationship between their place of assignment and that of the Ministry of Justice.

2. Attending to and resolving legal issues that may be referred to the various legal advisers timeously, effectively and conscientiously.

3. Familiarizing themselves with the specific legal needs of their MDAs.

4. Forestalling and reducing unnecessary litigation which would have involved the MDAs.

5. Ensure that all legal advice on all issues relating to their MDAs are first cleared with the Solicitor General and Permanent Secretary before final issuance so as to avoid conflict of ideas or policy and to ensure that only quality legal advice emanates from the Ministry or her legal officers.
